Terms of Sale

1. Scope and Validity of Terms

1.1. These terms and conditions (hereinafter the "Order Terms") apply to purchases made by the customer (hereinafter the "Customer") from the online store of Lindvior OÜ (hereinafter "Nailszone"), registry code 14822846, located at Tihase 34 – 1st floor, Tallinn, Estonia, via the website www.nailszone.eu

1.2. The parties shall follow these Order Terms, the Nailszone price list, and the applicable laws of the Republic of Estonia in their mutual relations

2. Conclusion of the Contract

2.1. The sales contract is considered concluded once the Customer pays for the order to Nailszone (the Customer’s acceptance of the Sales Contract). The contract becomes effective upon receipt of payment, after which Nailszone is obliged to deliver or send the goods to the Customer

3. Prices of Goods and Services

3.1. Product prices are shown in euros and include VAT

3.2. Nailszone reserves the right to change prices by publishing updated prices on the website. The Customer is guaranteed the prices that were in effect at the time of placing the order

3.3. If no price is shown or the product is listed at €0, this means the exact price is missing from the database. Please contact us by phone or email for clarification. The order will be adjusted, and confirmation will be sent to the Customer as soon as possible

3.4. Discounted prices are valid only in the online store

4. Payment and Delivery Methods

4.1. Available payment and delivery methods: products are delivered to the parcel terminal selected by the Customer (Smartpost or Omniva). Payment for goods and services must be made 100% in advance by bank transfer

Please note: When paying via bank link, make sure to click “Return to merchant” after completing the payment. Otherwise, the payment confirmation may not reach us, and the order processing may be delayed

5. Product Availability

5.1. Product availability is indicated in the product description. The data is updated regularly, but discrepancies may occur between the website and actual stock at Nailszone or its suppliers. Nailszone cannot guarantee product availability. In such cases, Nailszone will promptly inform the Customer, and the further process will be agreed upon based on the Customer’s preferences and Nailszone’s capabilities

6. Customer’s Right of Withdrawal

6.1. The Customer has the right to withdraw from the sales contract within 14 days of receiving the goods

6.2. To exercise the right of withdrawal, the Customer must send a written notice to [email protected] and return the product

6.3. The returned product must be unused, in original packaging, and include all labels and seals

6.4. Electronic components can only be returned if the packaging is unopened

6.5. If the returned item has deteriorated due to improper use, the Customer is obligated to compensate for the loss of value

6.6. Products made to order or customized to the Customer’s specifications are not eligible for return

6.7. Nailszone will refund the paid amount as soon as possible, but no later than 14 days after receiving the withdrawal request and the returned product or proof of return. The refund will be made to the Customer’s indicated bank account

6.8. The Customer is responsible for return shipping costs

7. Nailszone’s Right of Withdrawal

7.1. Nailszone has the right to cancel the sales contract if the Customer fails to pay the invoice on time or if the product is out of stock

7.2. From the moment of notifying the Customer, Nailszone will hold the ordered goods for 30 days. Refunds will be issued based on the Customer's request, minus handling, delivery, and/or storage costs

7.3. Nailszone also has the right to cancel the contract if fulfilling it is otherwise impossible

8. Warranty Conditions

8.1. If the product is covered by a warranty, Nailszone agrees to fulfill the warranty obligations by repairing or replacing the defective item in accordance with the warranty terms

8.2. The warranty period begins with the conclusion of the sales contract and is valid for the period specified by the manufacturer. An invoice must be provided to use the warranty

8.3. Unless otherwise specified in the warranty terms:

8.3.1. The Customer has the right to request free repair or replacement of the product during the warranty period
8.3.2. The warranty period does not extend during repairs
8.3.3. Replaced parts are covered until the original warranty period ends
8.3.4. A replaced product will not have a new warranty period; the original warranty duration continues

8.4. The warranty does not cover damage caused by mechanical impact, liquids, moisture, temperature, misuse, failure to follow instructions, or normal wear and tear

9. Claims and Defective Products

9.1. If a product is defective, the Customer must notify Nailszone immediately by email to [email protected] and provide the following information:

9.1.1. Name and contact details
9.1.2. Description of the defect and presumed cause
9.1.3. Order or sales contract number

9.2. Notification must be sent no later than the day after the defect is discovered. Failure to do so may result in the loss of the right to claim repair or replacement

9.3. Nailszone may require the defective product to be returned before providing a replacement

9.4. Nailszone will bear the cost of replacing a defective item

9.5. If repair or replacement is not possible, not completed within a reasonable time, or is unjustifiably denied, the Customer has the right to cancel the contract and return the item. Nailszone will refund the purchase price within 30 days of receiving the justified withdrawal request

9.6. Nailszone is not responsible for:

9.6.1. Damage caused by the Customer
9.6.2. Defects resulting from improper storage or use
9.6.3. Natural wear or physical changes in the product
9.6.4. The product not meeting the Customer’s expectations if no defect is present
9.6.5. Other cases as defined by law or contract

10. Liability and Force Majeure

10.1. Nailszone is not liable for:

10.1.1. Technical failures caused by third parties that prevent payment or contract conclusion. The Customer must notify Nailszone immediately of any such issues
10.1.2. Damages resulting from unauthorized use of the Customer’s identity

10.2. Breach of obligations is excusable if caused by force majeure circumstances beyond the party’s control

10.3. Nailszone is not responsible for delivery delays or confusion caused by incorrect information provided by the Customer or the Customer’s inability to receive the product

10.4. Nailszone does not compensate for non-material damage, third-party claims for non-material damage, or indirect damage such as lost profit

10.5. Nailszone does not compensate for losses if the Customer has assumed obligations regarding the product toward third parties

10.6. Nailszone is not responsible for damages caused by changes in delivery times, prices, or terms

10.7. Nailszone is not liable for damages resulting from exercising the right to withdraw from the contract

11. Retention of Ownership

11.1. The goods remain the property of Nailszone until fully paid for

12. Collection and Use of Personal Data

12.1. Nailszone does not disclose Customer data to third parties, except for delivery service providers

12.2. Marketing communications are sent only if the Customer has given explicit consent

13. Changes to Terms and Price List

13.1. Nailszone reserves the right to modify these terms and the price list

13.2. Changes will be published on www.nailszone.eu and take effect upon publication

13.3. Orders placed before the changes remain subject to the terms and prices in effect at the time of the order

14. Supervisory Authority and Dispute Resolution

14.1. Contracts based on these terms are supervised by the Consumer Disputes Committee under the Consumer Protection Board. More information is available by calling +372 6201 707 or 1330

14.2. The Customer has the right to submit a complaint to the Consumer Disputes Committee

15. Final Provisions

15.1. These terms and the resulting sales contracts are governed by the laws of the Republic of Estonia

15.2. If any provision is found invalid, it does not affect the validity of the remaining provisions. An invalid clause shall be replaced by a lawful clause that most closely resembles the original in meaning and purpose. These terms remain available on www.nailszone.eu
